Terms of Use

1. Definitions

• Platform: the website tip.dj and the associated DJ app at app.tip.dj.
• tip.dj: Weblord, based in the Netherlands.
• DJ: a user who receives song requests and tips via the platform.
• Guest: a visitor who submits a request or tip via the platform.
• Request: a song request submitted by a Guest, with or without a tip.

2. The platform

tip.dj provides a technical platform that allows Guests to send song requests and tips to DJs. tip.dj is an intermediary and is not a party to the agreement between Guest and DJ. tip.dj processes payments via Stripe as payment service provider.

tip.dj uses the Spotify Web API to retrieve song information (title, artist, album artwork). This use is subject to the Spotify Developer Terms of Service.

3. Use as a Guest

As a Guest you agree to the following:

• Submitting a request is a payment obligation when the DJ accepts the request (Track A: card payment) or after you pay via iDEAL/Bancontact (Track B).
• With Track A a payment intent is created. The amount is only charged after the DJ accepts; if declined, the hold is released.
• With Track B (iDEAL/Bancontact) payment is final and non-refundable after the transaction is completed, unless the DJ has not delivered the service.
• You must not abuse the platform, including submitting false requests or initiating chargebacks without valid reason.
• You are at least 18 years old or act with the consent of a legal representative.

4. Use as a DJ

As a DJ you agree to the following:

• You accept the platform fee of 10% on every successful transaction set by tip.dj, including transaction fees charged by Stripe.
• You are responsible for complying with any tax and legal obligations regarding received tips and payments.
• You process requests in good faith and play accepted songs as soon as reasonably possible.
• You are responsible for keeping your login credentials secure.
• You may not use the platform for illegal activities or copyright infringement.
• tip.dj reserves the right to suspend or delete a DJ account in case of abuse or persistent complaints.

5. Payments and fees

Payments are processed by Stripe, Inc. via Stripe Connect Express. By using the platform you also agree to the Stripe Connected Account Agreement.

• tip.dj charges a platform fee of 10% on every successful transaction.
• Stripe transaction fees (e.g. iDEAL: €0.29 per transaction; card: 1.5% + €0.25) are passed on and visible before payment.
• Payouts to DJs are processed automatically via Stripe Connect to the linked bank account.
• tip.dj is not liable for payout delays caused by Stripe or incorrect account information.

6. Cancellation and refunds

• For a Track A request declined by the DJ, the payment hold is fully released. Nothing is charged.
• Completed iDEAL and Bancontact payments are final. Refunds are only possible if the DJ demonstrably has not delivered the service, and after review by tip.dj.
• Refund requests can be submitted via support@tip.dj.

7. Liability

tip.dj is a technical platform and is not liable for:

• A DJ not fulfilling a request.
• Damage arising from use of the platform, unless caused by intent or gross negligence on the part of tip.dj.
• Temporary unavailability of the platform due to technical failures or maintenance.
• Actions or omissions of Stripe as payment service provider.

The total liability of tip.dj is in all cases limited to the amount of the transaction concerned.

8. Intellectual property

All rights to the content, design and technology of the platform belong to tip.dj. It is not permitted to copy, distribute or commercially use content from the platform without written permission.

9. Changes

tip.dj reserves the right to amend these terms. Changes will be announced at least 14 days in advance via the website or by email to registered users. Continued use of the platform after the effective date constitutes acceptance.

10. Applicable law and disputes

These terms are governed by Dutch law. Disputes shall be submitted to the competent court in the Netherlands. Consumers may also use alternative dispute resolution via the European ODR platform.
